Why Swiss businesses choose actaSIGN

Developed in Switzerland, hosted in Switzerland — with full functionality and personal service.

ZertES compliant with all signature qualities

actaSIGN supports all three ZertES signature qualities: EES, AES and QES. QES is equivalent to a handwritten signature (CO Art. 14 para. 2bis).

Data exclusively in Switzerland

All data is processed and stored in an ISO 27001 certified Swiss data centre. No AWS, no Azure, no Google Cloud.

Cross-border ready

Swisscom Trust Services is on the EU Trust List and Adobe Approved Trust List. Signatures are legally valid in the EU too — ideal for DACH business relationships.

Broad partner network in Switzerland

actaSIGN integrates seamlessly with Swiss DMS and IT solutions. Our local partners offer ready-made integrations and personal support.

Legal framework for electronic signatures in Switzerland

Switzerland has its own legal framework for electronic signatures with ZertES — independent from the EU, but compatible.

ZertES — Federal Act on Certification Services

ZertES governs the recognition of electronic signatures in Switzerland. Swisscom Trust Services is recognised as a certification body by BAKOM and audited by KPMG.

CO Art. 14 para. 2bis — Equivalence with handwritten signature

The qualified electronic signature (QES) is equivalent to a handwritten signature under the Swiss Code of Obligations. For contracts with statutory written form requirements, QES is the legally secure solution.

Freedom of contract and form

Swiss law generally provides freedom of contract. Most contracts can be concluded without formal requirements — EES or AES is sufficient for the majority of business transactions.

FAQ: Electronic signatures in Switzerland

Is the electronic signature legally valid in Switzerland?
Yes. ZertES (Federal Act on Certification Services) governs legal validity. QES is equivalent to a handwritten signature under CO Art. 14 para. 2bis.
What is the difference between ZertES and eIDAS?
ZertES is the Swiss signature law, eIDAS is the EU regulation. Both define three signature levels (EES, AES, QES). actaSIGN is compliant under both frameworks — via Swisscom Trust Services, which is recognised by BAKOM and listed on the EU Trust List.
Where is actaSIGN data stored?
Exclusively in Switzerland, in an ISO 27001 certified data centre. No AWS, no Azure, no Google Cloud — deliberately without international hyperscalers.
Which signature level do I need for Swiss contracts?
Most contracts in Switzerland are form-free (freedom of contract under CO). EES or AES is sufficient for the majority of business transactions. QES is required where the law mandates written form (e.g. guarantees, non-compete clauses).
Does actaSIGN work for cross-border contracts?
Yes. Swisscom Trust Services is on the EU Trust List and Adobe Approved Trust List. Qualified signatures via actaSIGN are recognised in all EU/EEA member states — ideal for contracts with partners in Germany, Austria and Liechtenstein.
